  • Under Hindu Marriage Act, 1955

Marriage is India can be registered either in Hindu Marriage Act or Special Marriage Act. The registration of marriage will be applicable for Hindus, Sikhs, Jains and Buddhists. The marriage is to be solemnized at the sub registrar office under whose jurisdiction, one of the partners are residing for more than 6 months. The marriage can be conducted according to the rituals and customs of either of the partners.

  • Under the Special Marriage Act

The citizens of India can get their marriage registered under Special Marriage Act. The couple that are going for marriage under Special Marriage Act, they need to get the notice to the sub registrar office within 30 days. This requires that the either of the partners should reside for more than six months under the jurisdiction of the sub registrar’s office. The registrar in this case will put a notice for 30 days  on the board and during this duration, he receives no objection for marriage then the marriage will get registered. In this case, the sub registrar should keep the copy of the notice. The individuals who are not eligible for registering under Hindu Marriage Act can go for this.  

Documents Required for Marriage Registration

  • Male applyoig for  Marriage Reggsitration should be 21 or more, in case of female it should be 18  or more.(Applicable for both Hindu Act and Special Marriage Act)
  • Residential Proof of both parties (Election Voter ID, PAN Card, Aadhar Card, Ration Card or Electricity Bill) 
  • If the marriage took place in a religious place, Institute’s Certificate that certifies the solemnization of marriage
  • If marriage is registered under Hindu Marriage Act then, RS 100 are to be charged. If marriage is registered under Special Marriage Act then RS150 is to be charged and is submitted to the District Cashier. The receipt of such payment has to be attached with the Application form.
  • Two Passport size photographs of both the parties. One marriage photo in case the marriage is solemnized.
  • If marriage is solemnized, Invitation card for wedding.
  • The parties need to affirm that they don’t fall in any of the prohibited relationship, mentioned under Hindu Marriage Act, 1955 or Special Marriage Act, 1954.
  • If eithre of the parties is divorcee, then attested copy of divorce decree is to be attached with the application form.
  •  Affidavit is to be attached with application form that states place, date, time of marriege along with the marital status and nationality of both the parties.
  • Two witnesses from both the parties needs to be present at the sub registrar office at time of meeting.
  • If marriage is solemnized, two witnesses needs to be present at the sub registrar’s office at meeting time who attended the wedding.
